1. Acceptance of Terms
By accessing or using FolioNames (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. FolioNames is operated by FolioNames Ltd, a company registered in England and Wales.
2. Eligibility
You must be at least 16 years of age to use the Platform. By using FolioNames, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into these Terms.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Platform to submit, host or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene or otherwise objectionable. You must comply with our Acceptable Use Policy, which forms part of these Terms.
5. Tool Submissions
Creators who submit tools to the Platform grant FolioNames a non-exclusive, worldwide, royalty-free licence to host, display and distribute the tool on the Platform. Creators retain ownership of their intellectual property. All tools must pass our security review process before publication.
6. Intellectual Property
The FolioNames brand, logo, design and proprietary technology are owned by FolioNames Ltd. You may not use our intellectual property without prior written consent. User-generated content remains the property of its creators.
7. Limitation of Liability
FolioNames is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's reliability, availability or fitness for a particular purpose. To the fullest extent permitted by law, FolioNames Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
